SB 1383 Waiver

Organics Collection Waiver Application

On January 1, 2022, in order to comply with Senate Bill 1383, all commercial businesses, multi-family properties (a residential premise with 5 or more dwelling units), and single-family residences (residential premises with fewer than 5 dwelling units) in South San Francisco are required to subscribe to compost collection services, unless they have an approved waiver. Customers with an approved waiver will not be required to subscribe to compost service.

Provided below is a brief description of each available waiver. Unless a waiver is approved by the City, businesses and properties are required to participate in the mandated collection services.

1. De Minimis Waiver (SSFMC §8.27.060(a)) - for businesses and multi-family properties that generate a minimal amount of compostable/organic waste (food scraps, food-soiled paper, and plant debris) depending on the amount of waste (trash and recycling combined) your business or multi-family property generates:

Less than 2 cubic yards of total weekly service Generate no more than 10 gallons of compostable/organic waste or recyclables per week
2 or more cubic yards of total weekly service Generate no more than 20 gallons of compostable/organic waste or recyclables per week

2. Physical Space Waiver (SSFMC §8.27.060(b)) – when there are physical space constraints that prohibit the addition of a compost container. Both businesses and multifamily properties are eligible to apply.

3. Collection Frequency Waiver (SSFMC §8.27.060(c)) - for businesses and residences with a low waste generation that are subscribed to the City's three-container Organic Waste collection service who arrange for the collection of their Blue Container, Gray Container, or both once every fourteen days, rather than once per week.

4. Self-Haul Waiver (SSFMC §8.27.100) - for businesses and residences that source separate all recyclable materials and Organic Waste generated on-site from Solid Waste, or shall haul Organic Wate to a High Diversion Organic Waste Processing Facility.

Enforcement

Accounts that do not have compost/organics collection service through South San Francisco Scavenger Co., Inc. or an approved waiver are subject to enforcement action and fine, effective January 1, 2024.
